CPIA - Criminal Procedure and Investigations Act 1996

This course is a must for those responsible for case paper preparation and management of sensitive issues and information arising out of investigation.

It deals with the disclosure process, how to complete the disclosure “bundle” and associated forms and address issues relating to sensitive information.

The disclosure file should be prepared at the same time as the evidential file and disclosure issues should be addressed as soon as a decision is made to prosecute.

For those considering enrolling on this course, it is important to distinguish between the two types of disclosure:

  • pre-trail: disclosure relating to preparation of documentation alongside a case papers evidential file
  • pre-interview: disclosure relating to the interviewing of suspects

Target Audience

All responsible for case paper preparation and management of sensitive issues and information arising out of an investigation

Aim

To enable delegates to comply with the disciplines of disclosure and properly manage sensitive information in accordance with CPIA 1996

Outcomes

To enable delegates to:

  • understand when the provisions of the legislation apply
  • define roles within the disclosure process
  • apply the principles of the three "Rs": record, retain, reveal
  • distinguish between what is sensitive and non-sensitive
  • understand use of sensitive disclosure to prevent sensitive information and investigation methodology being revealed
  • describe how to complete relevant forms and disclosure officer statement
  • understand revelation process to prosecutor and defence
  • understand ongoing responsibilities of a disclosure officer
  • explain the relationship of CPIA with PII (Public Interest Disclosure)
  • understand PII (Public Interest Disclosure) procedure

Delivery

The sessions will be delivered using a mix of PowerPoint presentation, flipchart explanation, group discussion, practical examples and case studies to reinforce leaning
