PIDA: Whistle blowing procedures

PIDA - Public Interest Disclosure Act 1998

Activities often occur in organisations which need to be brought to the attention of management. Individuals may be reluctant to do this for a variety of reasons.

Whistle-blowing is a regulated internal process designed to give anonymity to those who “blow the whistle”.

A full understanding of whistle-blowing is important in relation to privacy issues, managing whistle-blowers and confirming their status.

Sound whistle-blowing procedures and personnel trained to deal with the issues are essential because the motive or reason for blowing the whistle might not be what at first it seems. A whistle-blower might be a principle offender attempting to distract investigations or transfer blame

Enable delegates to comply lawfully and ethically with whistle-blower management

Outcomes

To enable delegates to:

• describe whistle-blowing and define of a whistle-blower
• identify key elements of effective arrangements
• identify risks of ineffective arrangements
• understand the difference between whistle-blowing, witness and grievance
• consider confidentiality issues, data protection and information security
• define anonymity and whistle-blower entitlement
• understand interview arrangements, corroboration and hearsay
• establish a process and designated persons for whistle-blower contact
• risk assessment in relation to whistle-blowing incidents
• assessment of and reaction to whistle-blower demands/requests
• management of the whistle-blower after the investigation is concluded
• respond effectively to the whistle-blower with an ulterior motive

Delivery method

The sessions will be delivered using PowerPoint presentations, flipchart explanation, group discussion, individual tuition and practical exercises to reinforce the course outcomes.
